THE TERMS OF THIS PRIVACY & DATA USE POLICY (“POLICY”) ARE  LEGALLY BINDING. IF YOU USE OUR SERVICES (AS DEFINED BELOW), YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS POLICY.

Tribe Innovations LLC (“Tribe,” “we,” or “us”) respects the privacy of its users  and has developed this Policy to demonstrate its commitment to protecting your privacy. This Policy is intended to transparently  disclose to you how we may collect, use and share your information. This Policy applies to you, as an individual or entity, when you use any of Tribe’s services, whether using our website (www.tribepool.co), our mobile applications, or any other web-based or mobile service or any offering through any of our websites (collectively, our “Services”).

Please read the Privacy Policy carefully to understand our practices regarding your personal data and how we will treat it. Please pay particular attention to the sections entitled “International Transfer” and “Your Rights.”

Who we are. For the purpose of applicable data protection legislation, the data controller of your personal data is Tribe Innovations LLC at 5313 South Maryland Avenue, Chicago, IL 60615, USA. Our data protection officer may be contacted by emailing support@tribepoolco.

What Is Personal Data? We collect information about you in a range of forms, including personal data. As used in this Policy, “personal data” is defined as in the European General Data Protection Regulation of 2018 (“GDPR”), and includes any information which, either alone or in combination with other information we hold about you, identifies you, including, for example, your name, postal address, email address and telephone number.

Why Do We Need Your Personal Data? We need certain personal data in order to deliver the Services to you.

Your Consent. By registering with Tribe or submitting personal data through our Services, you expressly consent to the collection, use and disclosure of your personal data in accordance with this Policy. We will process your personal data in accordance with applicable data protection and privacy laws. When you register with us, you are required to consent to our Policy. This consent provides us with a legal basis under applicable law to process your personal data. You maintain the right to withdraw such consent at any time.

Information we receive about you

In General. We receive a number of different types of information from you when you use our Services, some of which is personally identifying, some of which is not. The information received through our Services may be sent to or stored on servers located in the United States and other countries around the world.

Information you provide or a school or school district provides on your behalf. We may collect and store any personal information you provide through the Services or that is provided to us in some other manner in relation to your use of the Services. This includes identifying information, such as your and your family members’ (if applicable) full names, mailing address, email addresses, images, telephone numbers. We also may request information about your interests and activities, your location, and other demographic or profile information.

Information from other sources. We may also periodically obtain both personal and non-personal information about you from other users (when they invite you to a trip or to join a carpool through our Services), our business partners, contractors, and other third parties (including schools and school districts) and may add it to our account information or other information we have collected about you. Examples of information that we may receive include but are not limited to: name, contact information, updated pick up and drop off or address information, and additional demographic information such as grades of your children.

Analytics. We may use third-party analytics providers (like Google Analytics and Mixpanel) to help analyze how users use the Services. These analytics providers use cookies and other technologies to collect  information such as how often users use the Services, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from these providers only to improve the Services. They collect the IP address assigned to you on the date you visit the Site or use the App, rather than your name or other personally identifying information. We do not combine the information generated through the use of such analytics with your personal data.

Mobile Devices. We may receive information from your mobile devices when you visit our Services, such as geographic or geolocation information. If you choose to turn off identifiers such as locational tracking on your mobile device, please note that you may not be able to use some of the interactive features offered through our Services.

How we use the information we collect

We may use information that we collect about you to:

● to facilitate the creation of your account with Tribe

● to provide you with the Services;

● deliver invitations and/or reminders that you have requested;

● share information you have voluntarily provided about yourself with  other guests who have been invited to the same events;

● manage your account and provide you with customer support;

● to improve our products and Services;

● communicate with you about products or services that may be of interest to you;

● verify your eligibility and deliver prizes in connection with contests and sweepstakes;

● enforce our Terms of Service;

● manage our business; and

● perform functions as otherwise described to you at the time of collection.

With whom we share information

We want you to understand when and with whom we may share personal or other information you have provided to us or that we have collected about you or your activities on our Service. We may share information with:

Other Users. Users and/or guests invited to the same trips and or schools as you may be able to view the personal information that you provide on your profile page and on carpool invitations. Users and/or guests invited to the same trips as you or included in the same communications as you will also be able to see the content of any messages you post or send related to the trip.

Authorized service providers. We may share your personal and non-personal information with our authorized service providers that perform certain services on our behalf. These services may include, but are not limited to, sending SMS or email reminders, providing customer service and marketing assistance, performing business and sales analysis, supporting the functionality and data and technology infrastructure of our Services, and supporting contests, sweepstakes, surveys and other features offered through our Services. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

Anonymized Data. We may create anonymous data records from the personal data we collect by excluding information (such as your name or email address) that makes the data personally identifiable to you. We use and analyze this anonymous data to help us better understand how our Services are being used. By identifying patterns and trends in usage, we are able to improve our Services. We reserve the right to use anonymous data for any purpose and to disclose anonymous data to third parties in our sole discretion.

Other Situations. We also may disclose your information:

In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Services terms and conditions or other agreements or policies. In connection with a corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. We do not share your personal  information with others except as indicated herein or when we inform you and give you an opportunity to opt out of having your personal information shared. Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Policy.

Third-party websites

Through our Services, you will be given an opportunity to access other third-party websites that do not operate under this Policy. For example, if you choose to integrate your account with one of our partners, you may be taken to a website that we do not control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. Tribe is not responsible for the practices of these third parties, and we recommend that you consult the privacy statements of all third-party websites you visit to review how they use information collected from you.

How you can access your information

If you have an account on our Services, you have the ability to review and update your personal information by logging into your account on the Services and visiting your profile page. If you have an online account with us, you also may choose to close your account at any time by visiting your profile and selecting “delete account” or by emailing us at support@tribepool.co. After you close your account, you will not be able to sign in to our Services or access any of your personal information. However, you can open a new account at any time. Please note that if you close your account, we may still retain, use and disclose anonymized information associated with your account, as well as copies of previous communication that we had with you.

Your Rights

You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Services because such information may be required in order for you to register as a member and to set up and manage your carpools; participate in a contest, promotion, reward program, survey, or sweepstakes; ask a question; or initiate other transactions through our Services.

If you wish to exercise any of the following rights, please contact us using the details below. In your request, please make clear: (i) what personal data is concerned; and (ii) which of the rights you would like to enforce. For your protection, we may only implement requests with respect to the personal data associated with the particular email address or phone number that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable and in any event, within one month of your request. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.

Opt-out. You may contact us anytime to opt-out of: (i) direct marketing communications; (ii) automated decision-making and/or profiling; (iii) our collection of sensitive personal data; (iv) any new processing of your personal data that we may carry out beyond the original purpose; or (v) the transfer of your personal data outside the EEA. Please note that your use of some of the Services may be ineffective upon opt-out. Despite your indicated e-mail preferences, we may send you service-related communications, including notices of any updates to our Terms of Use or Privacy Policy.

Access. You may access the information we hold about you at any time via your Tribe account, where applicable, or by contacting us directly.

Amend. You can also contact us to update or correct any inaccuracies in your personal data.

Move. Your personal data is portable – i.e. you to have the flexibility to move your data to other service providers as you wish.

Erase and forget. In certain situations, for example when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your data.

How we protect your personal information

We take reasonable and appropriate security measures (including physical, electronic and procedural measures) intended to help safeguard your personal information from unauthorized access and disclosure. For example, only authorized employees, contractors, and service providers are permitted to access personal information, and they may do so only for permitted business functions.

We want you to feel confident using our Services to transact business. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure.

International Transfer

If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using our Services, you understand and consent to the transfer of your information to our facilities outside of your country.

No Rights of Third Parties

This Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Services.

Changes to this Policy

Tribe reserves the right to amend this Policy at its sole discretion and any modifications shall be effective immediately upon posting. We will notify you about material changes in the way we treat personal data by sending an email message or text message to the email address or phone number you most recently provided to us or by prominently posting a notice of the new Policy on the Services with the “Last Updated” legend at the top of this page. By continuing to use the Services following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Policy or any changes thereto, you may discontinue using the Services.
